Welcome to MYX Metaverse. (MYX ARKADIA and MYX Related products and services) Your privacy is important to us. This Privacy Policy explains how we collect, use, and share your information when you use our services. We strive to maintain transparency and ensure compliance with applicable laws and regulations, including Meta Platforms, Inc. (“Meta”) policies when integrated services are used.

When you use MYX Metaverse, we may collect:
  • Account Information: Name, email address, username, and password for our platform. 

  • Profile Information: Avatar details, preferences, and any additional details you choose to provide.

  • Purchases: Payment details for VIP memberships or digital goods (processed securely by third-party payment providers)  to allow for access to subscribed and or purchased/gifted/obtained services.

1.2 Information We Receive from Meta Services

When you connect to MYX Metaverse through Meta platforms or services (e.g., Facebook Login, Oculus, or Horizon integrations), we may collect:

  • Facebook Profile Information: Your name, profile picture, and friend list.

  • Device Information: Details about the Meta device you’re using, such as model, operating system, and app usage statistics.

  • Activity Data: Actions you take while using Meta-integrated features (e.g., joining a venue or interacting with social features).

1.3 Automatically Collected Information
  • Usage Data: Information about your interactions with MYX Metaverse, including game progress, in-game purchases, and event attendance.

  • Device Information: Data about the hardware and software you use to access MYX Metaverse, such as IP address, device type, and operating system.

  • Player Preferences File: Personalized data willingly supplied by the user is stored locally on the device in the "player prefs file." This includes usernames, game save files, player progression, and other game-related data essential for managing the player's progress.

We use the information we collect to:

  • Provide and improve MYX Metaverse services, including social features and account management.

  • Enable integrations with Meta’s services, such as social login and friend lists.

  • Process transactions and provide customer support.

  • Customize user experiences and provide personalized recommendations.

  • Comply with legal obligations and protect the integrity of our platform.

3. How Information Is Shared

3.1 Sharing with Meta Platforms

  • Social Features: Sharing profile names and friend lists to enable social interactions.

  • Device Data: Providing usage statistics to improve compatibility and performance.

We do not share personalized data with any partners except as described in this policy. Any data shared with third-party service providers (e.g., payment processors, hosting services) will be anonymized to ensure no personally identifiable information is transferred, unless legally required by law.

4. Your Choices and Controls

4.1 Managing Account Data

You can access and update your account settings within the MYX Metaverse website, or by using the Clear Cache button which will delete stored data on your personal device. We do not control or have access to this data, and once you delete this information, we cannot retrieve it. Please use careful discretion when selecting this option.

4.2 Opt-Out Options

You can opt out of certain data collection and sharing practices by adjusting your preferences in the settings menu.

If you have agreed to receive commercial email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt out from receiving commercial email from us by submitting a request at https://myxmetaverse.com and selecting  Contact Us and subject line “I want to invoke my rights concerning my personal information” or by writing to us at the address given at the end of this Policy. We may allow you to view and modify settings relating to the nature and frequency of promotional communications that you receive from us in user account functionality on the Platform.

Please be aware that if you opt out of receiving commercial email from us or otherwise modify the nature or frequency of promotional communications you receive from us, it may take up to ten business days for us to process your request, and you may continue receiving promotional communications from us during that period. Additionally, even after you opt out from receiving commercial messages from us, you will continue to receive administrative messages from us regarding the Platform.

4.3 Data Deletion Requests

5. Data Retention and Security

We retain your information as long as necessary to provide MYX Metaverse services and for legitimate business purposes. Meta’s services are utilized to ensure the highest levels of security, encryption, and capabilities. We do not record body movements, finger movements, or eye tracking for any purpose other than live, direct communication as expected by the player. No recordings or stored data are made from these sensor systems.

6. Children’s Privacy

MYX Metaverse is not intended for children under the age of 13. We do not knowingly collect personal data from children. If we become aware of such data collection, we will take steps to delete it promptly.

7.  International Visitors

The Platform is hosted in the United States. If you choose to use the Platform from Europe or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that your Personal Information is processed and stored outside of those regions, in particular in the United States. Also, we may transfer your data from the United States to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating the Platform. By providing any information, including Personal Information, on or to the Platform, you agree with such transfer, storage, and processing. 

If you are located in Europe, we will comply with applicable data protection laws when transferring your Personal Information outside of your country.  

If you are from Europe, we may transfer your Personal Information to countries which have been found to provide adequate protection by the EU Commission or the UK government, to recipients who use contractual protections for the transfer of Personal Information, or to recipients who have adopted Binding Corporate Rules. We may also rely on an appropriate legal derogation. For more information about how we transfer outside of Europe, or to obtain a copy of the contractual safeguards we use for such transfers, you may contact us using the contact details as indicated in the "Contact Us” section below.

If you are located in the European Union or Brazil, we only process your Personal Information when we have a valid “legal basis,” including as set forth below:

  • Consent. You have expressly consented to the use of your Personal Information, for example when you consent to receive electronic marketing communications or when you consent to the use of Cookies. 

  • Contract. We need your Personal Information to fulfil a contractual obligation to you. For example, we may need to process your Personal Information to link your MYX VIP subscription to your account.

  • Compliance with a Legal Obligation. We have a legal obligation to use your Personal Information, for example to comply with tax and accounting obligations. 

  • Legitimate Interests. We or a third party have a legitimate interest in using your Personal Information to provide you access to the Platform. Specifically, we have a legitimate interest in using your Personal Information for product development and internal analytics purposes, and to improve the safety, security, and performance of the Platform.  

We only rely on our or a third party’s legitimate interests to process your Personal Information when these interests are not overridden by your rights and interests.

If you reside in Brazil, you have additional rights relating to your Personal Information, including: 

  • The right to know and access the Personal Information we have collected about you; 

  • The right to request that we delete your Personal Information; and 

  • The right to request that we correct your Personal Information. 

If you would like to invoke your rights and request that we take action regarding your Personal Information, or if you have any questions, concerns, or complaints about how we are using your Personal Information, you may contact us at by submitting a request at https://vrch.at/support and selecting the Support Category “I want to invoke my rights concerning my personal information.” You can also submit a complaint to the National Data Protection Authority of Brazil through its official channels.

Your ability to invoke the rights described above may be limited under applicable law. Before fulfilling your request, and to the extent permitted under applicable law, we may ask you to provide additional information to allow us to verify your identity.

If you reside in the European Economic Area (“EEA”), the United Kingdom, or Switzerland (together, “Europe”), you have additional rights relating to your Personal Information, including:

  • The right to receive a copy of your Personal Information in a structured, commonly used and machine-readable format and to request that we transmit such information to another controller without hindrance where technically feasible; 

  • The right to request that we delete your Personal Information; 

  • The right to request that we correct your Personal Information; and 

  • The right to request that we stop using all or some of your Personal Information, or that we limit our use of your Personal Information. This includes objecting to our use of Personal Information that is based on MYX's legitimate interests. We may continue to process information after such objection or request to the extent required or permitted by law. 

In addition, you also have the right to appeal a decision we have made regarding the exercise of your privacy rights and to lodge a complaint with a supervisory authority, including in your country of residence, place of work, or where an incident took place. 

Our legal bases for processing your Personal Information are described in Section 6, below. You may withdraw any consent you previously provided to us regarding the processing of your Personal Information at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of any processing that occurred before you withdrew your consent.
